What's the difference between Cal/OSHA and federal OSHA requirements?
California operates an OSHA State Plan, which means Cal/OSHA standards must be at least as effective as federal OSHA standards and in many areas are stricter. Notable examples include California's Heat Illness Prevention standard, its Aerosol Transmissible Diseases standard, and various requirements around written program documentation. Businesses operating in California need to follow Cal/OSHA, not just federal OSHA.
Does my business need an Injury and Illness Prevention Program?
Yes, if you have employees in California. The IIPP is required for virtually every employer in the state under Cal/OSHA Title 8, Section 3203. It's one of the most commonly cited deficiencies during inspections. The program needs to cover hazard identification, communication, and correction, along with training and recordkeeping requirements.
What triggers a Cal/OSHA inspection?
Cal/OSHA inspections can be triggered by employee complaints, referrals from other agencies, serious injuries or fatalities, or programmed enforcement targeting specific industries. Some inspections are random. Having current written programs, documented training records, and a physically compliant workplace is the best way to limit your exposure regardless of what triggers an inspection.
What is a Hazard Communication program and who needs one?
A Hazard Communication program is required for any workplace where employees may be exposed to hazardous chemicals. It needs to include a written program, Safety Data Sheets for all hazardous chemicals, proper labeling, and documented employee training. This applies across a wide range of industries, from manufacturing and construction to janitorial and food service.
How do California's hazardous waste requirements differ from federal RCRA?
California's hazardous waste regulations, administered by DTSC, are stricter than federal RCRA requirements in several important ways. California has additional listed hazardous wastes, stricter generator thresholds, and more stringent requirements around waste characterization and storage. Businesses that comply with federal RCRA aren't automatically compliant with California law.
What is a CalARP program and does my facility need one?
The California Accidental Release Prevention program applies to facilities that store regulated substances above threshold quantities. It requires a risk management plan and in some cases a more detailed process hazard analysis. CalARP thresholds and covered substances differ from federal RMP requirements in some cases, so facilities need to evaluate both programs separately.
